but we've got to go to 18, u.s. code 18, section 793. he said they acted extremely carelessly. the statute says gross negligence. can you explain what the difference is? >> well, no. the legal definition of gross negligence is extreme carelessness. so the standard that the director of the fbi put forward is a violation, a felony under federal law. so what happened here, without a doubt, the fix was in since the beginning. this was a faux investigation. as our friend, andy mac carthy has said, director comey rewrote the statute to get the result that someone desired. obviously the clintons desired, but maybe even higher up. and the fact of the matter is, sean, at the end of the day, if you look at the gross negligence standard, that is when someone is careless to an extreme. that's the legal definition of gross negligence. >> this is the thing.
